Why would the judge construe that? This is not news. MSFT products assume IE will be there because that's part of the advantage of having it integrated. MSFT has made it painfully clear for over a year that this is and will be the case.

The injunction settlement says a Win95 OEM version without the IE icon must be offered. It does not tell MSFT to go change all the assumptions in their code that IE is present.
