When you have done tests, that were part of mask testing prior to HC doing a lung toxicity study. The mere fact you have done the tests just means that when they change the testing criteria, you will be one test short of getting approval and that test will be a human trial to determine lung damage or not.
Now assuming HC can find someone that has already done human lung studies and assuming the GO is the same as what ZEN is using, then they "may accept that srtudy". But, thats not like HC, they prefer to postulate, procrastinate until FDA gets a study done.
So ZEN is trying to be nice in hopes they will slide under the new testing wire. I personally believe HC cannot afford to let anyone under the wire. Having ZEN do, and pay for the trial works for HC because then they do not have to do it and it gets done.
