Let me reverse it. If a country attacked the US and civilians defended ourselves, our families, and our country, could the attacking country call us terrorists and kill us? We attacked Iraq and we were the terrorists.

You asked if Saddam had WMDs. He had them in the first Gulf War and didn't use them. Then the UN dismantled them. There's no evidence whatsoever that they reconstituted them before the second war.
