The filibuster came about more or less by accident. Both the early House and Senate had rules about cutting off debate before a vote that were deemed too draconian. Both houses eliminated those rules, but only the House replaced the rules with more reasonable ones. The Senate never did. And so the filibuster was born. It was something that was rarely used until the Civil Rights era. And it has only become more and more common since then.
