The goverment might well refuse to be sued. Many governments have statutes that stop it.
If KRY wins completely the only grounds PDG to sue will be on loss of surface assets basis. So give them back and make PDG go away.

However i suspect this is such a hot potatoe that the Ven government will accede to a compromise by fiat.
