They(Intel) was very public about their interest, and it is possible that they believed as you stated they would just out bid everyone. However, they may have been distracted by the Digital law suit and under estimated the interest in those patents.

<It would seem that Intel is not worried about any impact that they would have on any of their proposed processors.>

It could be that the giant was caught napping, it should have a direct effect on their mercer chip, if nothing else a threat of a infringement suit.
