Hmmm. Only one of them actually HAS executive privilege because ... he's the EXECUTIVE.

The SCOTUS would create a very tangled web if the last president could "trump" the current one with respect to "protected content of the executive office". Especially if that was a twice impeached president who didn't win by any majority nor the undemocratic EC.

Might as well have a blood-line succession if that is the case.
