Reading Peter Lynch, (which may be outdated but) he said the SEC prevents a Mutual Fund from owning more that 10% of the shares of any one company and they cannot invest more that 5% of a funds assets in any one stock. So I'm assuming that if ML wanted to own more than 10% they would have to spread their shares around. And if the buyback were significant enough ML et.al might be forced out of a few shares.
