Sorry for the double post, but in the interest of discussing the merits...some have said that "if SNUS loses the patent case, it has further to fall" or words to that effect.
My understanding of the patent situation is that the patent office is in the process of ruling on the validity of several patents in this area, including two from SNUS. Outcome uncertain. At the same time, SNUS has filed a lawsuit against MB claiming infringement of these two patents. At this time, MB has no pending lawsuits against SNUS. The suit thrown out from the DC District court for jurisdictional reasons was filed by MB for the express purpose of preventing SNUS from filing its infringement suit. Now that the suit has been filed, MB has no reason to refile. MB has made some vague comments about future action against SNUS, but there seems to be no basis for it. MB's primary patents cover the coating used to cover the gas microbubbles. SNUS uses an entirely different method, which does not use the same albumen coating. So, if everybody's patents are overturned, all it means is they compete in the marketplace. That is a win win for both companies. If SNUS wins the patent case, sayonara MB. Just my take..
