A jury's job is to figure out if a Joe sixpack would have done any better. This is the difference between jury trial and bench trial. The jury is there to take the human side of the equation into account.

Responsibility always has multiple stakeholders. We live in an imperfect world and we cannot dole out perfect justice in the right amount to all the guilty people involved. If a mob was after you, if you feared they could stampede on you, if someone was to blogeon you with his skateboard and possibly kill you, then I am pretty sure you would have fired your gun rather than take out the legal code to see what the right action is.

Nobody tells you to punch a guy in the mouth when he starts hitting on your girlfriend in a bar and makes passes at her and calls you names in front of everyone. But most people would. Should you be held responsible for assault? Good luck finding a jury who would convict on that even though the law is on the side of the conviction...and btw, how about holding that jerk responsible for his actions? Now if you leave the bar and go to your car and get a gun to shoot him in the head, then you've gone overboard and deserve to be convicted of murder.

But most cases are not so cut and dry. What if you and the jerk got physical. As far as the law is concerned, even if he hit you first, you are not supposed to hit back. You are should call the cops and file charges. But in real life, good luck with that getting you anywhere. So you punch back and he beats the crap out of you and grabs a bar stool to smash your skull with. And that is when you shoot him. Are you still guilty of murder? This is what the jury will have to decide based on legal arguments. Would they have acted differently if they put themselves in your shoes.
