Lou I am going to give you my perspective and then I think, at least on my part, it's been beaten to death.

I see it as self defense because:

(1) At the moment that he pulled the trigger he was under attack. He was not charged with "provocation" or poor judgement. He was charged with murder.

(2) There was no adequate police force and police actually welcomed his help. So the idea of a civil society of law and order did not apply in this particular instance.

(3) He did not go in middle of the protest. The protest came to him. There is a difference.

(4) Actions are decided based on the frame of mind. Murder is when you go somewhere with the intent to kill. There is no evidence that he went with the intention of hurting anyone. All the evidence said he went with the intention of protecting.

As I have said, if they had charged him with poor judgement or reckless endangerment, or maybe even manslaughter, then there would be a better chance of conviction. But there simply wasn't any evidence for murder.
