Let me simplify it for you.
Without a delivery system you have nothing.
HVSF delivery system is already patented by Vivus, therefore you have no marketable product unless you can drink the stuff.
Example: Car without Wheels. (Useless)

Nothing will prevent HVSF from getting FDA approval for their product. It's when they attempt to sell the product that Vivus will file a patent infringement.
