I hope that Mr. Batman will not be too angry at us for discussing this product thing again. Apparently, he would rather have us discuss some bad guy who was on HVSFD board years ago and was subsequently kicked out, or he would rather have us discuss this cell phone guy from London.

In any case, the HVSFD patent covers both the drug as well as the delivery system. And I believe that the HVSFD delivery system does not infringe on Gene Voss's patent for delivery system. VVUS has the rights to the Gene Voss's patent.

At this point we both can argue endlessly about this. However, as I understand, the HVSFD patent will become a public document on or around Feb. 18, 1998. Gene Voss's patent can already be viewed on the internet. Once you review both of these patents, you can decide for yourself.

So, not only this car has wheel, it apparently has some high performance one.

Also, looks like that it will not come to a point where VVUS may have to file a patent infringement court action. HVSFD has already initiated a court action requesting for a declaratory judgment that will have this issue addressed much sooner than the final FDA approval. It is my understanding that the VVUS attorneys with $100 million to spend are relying at the moment on "motions for continuance" to support their case. Does not look too good for them.

I do grant that in any legal proceeding there is always a possibility of an unexpected outcome for either party. Since you don't own any shares of HVSFD, that is some thing you do not have to worry about.
