The evidence against CP is overwhelming in my opinion.
Cost savings should never put workers or the public in jeopardy.
The TSB recommendations being made to CP are all indicative in my opinion.
1) Test the brakes properly for the conditions and the load expected.
2) Make setting parking brakes automatic, start with commodity cars on mountain grades.
3) Prove that what you are doing for safety works, prove it is effective.
Five thousand grain cars were taken out of service once proper inspections were done.

CP is standing behind the fact that they followed the rules.
CP claims everything was fine and there were never any safety issues of which they were aware.
The continued warnings from those working on the Laggan subdivision were ignored.
There were many years of warnings and continued employee reports, the railroad ignored them all.
No special training was provided despite the repeated employee warnings.
CP's defense seems to be if it happens again tomorrow, it would not be our fault, we followed the rules.
