Yesterday, the DNC, Hillary for America, Fusion GPS and one or two other culprits moved to intervene in the prosecution to attempt to keep the documents from being revealed or used in Sussman's prosecution.
This is after the Judge refused to grant Sussman's motion to dismiss, and the prospects of having the documents introduced into evidence at the trial suddenly became a lot more probable. In other words, the heat was on.
The argument, of course, was that Perkins Coie, as general counsel for Hillary for America and the DNC, hired Fusion to do legitimate legal work such as checking on Trump's Scottish venture, etc.
I very briefly scanned the documents and the declarations by Mook, Podesta, Marc "Butterball" Elias and other assorted barf bags. Can't say that their arguments were very convincing. Hearings, if I recall correctly, are on April 30.
Should be interesting.
I believe the judge will take a look at the documents in camera and rule accordingly.
My further guess is that if the District Court rules the documents admissible, Hillary for America, the DNC, Podesta, Elias, and the rest of the sleazoids will take the matter up with the Court of Appeals in an effort to derail the trial. Not a bad tactic considering the make up of that Court
The case is very interesting because there is no indication thus far that Sussman will plead and rat out the others in order to get a favorable deal. My guess is that promises have been made - "Go ahead, take the hit, we'll take care of you after you get out of jail, if you ever go there. You'll lose your law license, but there are lots of other lucrative jobs we can find for you. Don't sweat it. On the other hand, if you rat us out, you will definitely regret it."
Technofog has a very good look into all this:
