The patent office can only respond to information at its disposal when granting a patent.In fact it is incumbent on the filer to disclose all pertinent data in the public domain he is aware of to ensure a valid patent. Knowingly withholding other patent data or public information is grounds for invalidation.I don't believe HVSD would take this chance.
This is still all academic since the patent is only a piece of paper which the filer must enforce at considerable cost.Give me an average patent in strong hands over the reverse any day.
