1 and 2 don't matter much. Regulations from the executive branch need authority in law, constitutional limits on what laws can be passed also limit regulation. Even not regulatory executive actions (like executive orders, which are directly on presidential power, not based on law) are generally considered to be limited by any part of the constitution that says "congress shall pass no law".

As for 3, I think its less clear than one or two, and also an issue that I've considered less often so I don't have much of an opinion about it.
