You are correct, but if we don't embrace the principle, and admit the mistakes, than all is lost. Just because it fails sometimes is no reason to throw it out. As far as circumstantial evidence goes, that's usually left up to a jury presided over by a judge. You can think anything you want, everyone does, I just take exception to it being published in a public forum, that's all.
