Billy, here's a cpa's attempt at your questions -

1. Vivus can already sell to the UK; as the UK isn't governed by Europe's drug laws.

2. Correct - if the product their making on the yet to be approved lines turns out to be bad - or the lines faulty in any way - the product would have to be destroyed.

3. Correct - on FDA approval - they've been thru the process already - they have brought on outsiders - and for all intents and purposes, no one believes that the plants won't be approved.

4. Who really knows if the analysts will put out a favorable rating? I've talked to two; and one said that if the new plant is approved and the sales stay strong; an upgrade is highly likely. The 2nd one would not let me pin him down on the issue of an upgrade - but I sensed he would.

5. Vivus's worldwide distributor is Astra - and yes - I think Astra is a subsidiary of J&J - but not 100% positive. Suffice it to say VVUS can't even begin to come close to meeting demand for the limited markets it's in now. And they will be selling everything they can make for as far out as the eye can see.

Out.
