Filing for a patent and having a patent approved are the alpha and omega of the patent process. 1. Filing does not guarantee you will be issued the patent. 2. Patents usually require a number of years before they are approved. In summary, even if they file for the patent today, the patent cloud will not be removed over BAT's head for sometime--say two years. This is something that will haunt BAT for sometime to come.
