Of course not... The believer pushes the unbeliever to his death from religious zeal, to try and stop him pushing people to their death infringes on his right to practice his religion, this is against the Constitution.

The unbeliever has no religious beliefs and therefore has no religious rights, he is a sacrificial lamb for the believer, there is no violation of the Constitution.
