Example...

I know a billionaire that would change girl friends every few years. He considered 45 to be the ideal age and would let them go after 3-5 years(He did this throughout his life from 50 on). He has a spectacular home. Every time the new girl moves in she wants to "remodel" the home(i.e. eliminate all vestiges of the prior GF). One time his new girl was a professional interior designer. He let her use her own $$$ to remodel to the tune of 900k. I suspect he wasn't 100% sure she would make it the normal 3-5 years so this time he wasn't going to spend his $$ having her remodel. So she finished the remodel and asks to get reimbursed and he reimburses her right out on the sidewalk, now much poorer. She sues. Fees on her end are $350,000. She wins. He appeals. She tells her atty to go for it. He says. "An appeal in this case will be $500k because this guy is a billionaire and it will be expensive". She says, "I don't have it. I used all my money to fix up his house and pay you my last $350k to get it back and i won!"

She lost on appeal because no atty would take her case on contingency knowing he would spend 500k in hours and then have the case appealed to the next level.
