"No one can prove that those documents fell into enemy hands."
Nor into friendly hands. I don't think we'll see an email saying, "OK, MBS, you play 3 tourneys at my golf courses, and I'll give you plans to invade Iran." However, our intelligence may notice sources disappearing, or maybe opposition vulnerabilities being shored up in the next few years, suggesting that somebody had access. Doesn't matter, tho, as far as the law is concerned.

"No one can prove that he intended to do harm to our national security" That's why we have the "law" of unintended consequences, AKA "The road to Hell is paved with good intentions". Fortunately, Smith only has to prove Trump intended to keep his ill-gotten goods.

"Let them express their loathing at the ballot box." They did. They were the 81 M Never Trumpers who appeared in the next line. --
"That's why, if I were Trump's defense attorney, I would argue for jail time and a fine." I'd do that if I was Smith, too. Whatever the max is, plus Mar a Lago and Bedminster under the asset forfeiture law. |
