Yes, ConEd involved a material breach by the buyer.

As for timeline, I don't think there's any world that MaxLinear will succeed in proving that their termination was lawful, whether a short case or a long case.

Both Cineworld and McCormick make reference to the ConEd case.

Of course Silicon Motion is going to try to get these damages. And of course they should. It's just likely to be an uphill battle.

Specific performance should be an easy battle.

Both of which may bring MaxLinear to the table to settle for medium-level damages.
