What is Section 238 of the Cayman companies Act?

Section 238 of the Cayman Islands Companies Act gives shareholders a statutory right to dissent from the merger of a Cayman Islands incorporated company, and to be paid a judicially determined fair value for their shares instead of the merger consideration being offered by the merging company.

While that is not really relevant here as there is nothing being offered for SIMO shares, and therefore no need for a judge to determine their fair value, but it DOES point in the direction of Cayman judges deciding things about the value of Cayman shares.

I like the idea that Cayman law encourages judges to give Cayman shareholders fair value.....for anything!
