SpaceX attempts to throw "monkey-wrench" into Globalstars attempts to register it's new constellation in the US.

I think SpaceX brings up some interesting points.

First HIBLEO-4(US) and HIBLEO-X(France) are 2 different constellations. Registered via the ITU in 2 different countries, and registered under different companies. (Controlled by one).

It appears that France may not be interested in continuing to sponsor Globalstar's new North American built satellites, as it's decade long "relationship" has been "estranged" on occasions. The Export Credit Loan has been repaid, so France has no direct "skin-in-the-game" in continuing the relationship.

So it appears, Globalstar comes groveling back to the FCC after the 2009 lawsuits, Rules Violations, Consent Decrees, etc.

The HIBLEO-4 constellation has largely been "abandoned". In their 2017 repositioning notification. Globalstar noted it only had 7 remaining first-gen HIBLEO-4 satellites still providing services. That was 6 years ago. So today, it is likely that the original HIBLEO-4 constellation is in effect dead. The rules require rapid replacement of failures. To this effect. Globalstar has seemingly merged the two constellations into one from an administrative standpoint with the FCC as a policy.

SpaceX filed for the use of the Big LEO frequencies with the ITU back in December 2022.

SpaceX's viewpoint is that Globalstar effectively "abandoned" the HIBLEO4 authorization. Globalstar is not entitled to "replenish" satellites that have been out of service, in some cases, for a decade. Globalstar must file to the ITU via the FCC to register it's new constellation of 26 satellites. In that case. SpaceX's application to the ITU would have "priority" over any new constellation, including a new US sponsored constellation.
