As far as the company is concerned the settlement is done, over, finished! They no longer owe anything to anybody. They paid $8.5 million (in the form of cash and stock), and the amount has already been taken into account in their earnings, etc.

However the actual distribution has not yet taken place as it is up to the judge in the case to decide who should get and by how much. And to the best of my knowledge no plaintiff in the case takes precedence over anyone else.

I who am an existing share holder of over 3 1/2 years who is also a plaintiff in the case have not received nor been notified of any decision as how much the judge is going to give me, and I do not believe any plaintiff in the case has heard or received anything either.

Can not wait till tomorrow morning to call the litigiation office to find out what is going on.

As for calling the CFO, can someone please provide me the number I can call.

Thanks,

Addi Jamshidi
