I don't think it should be considered discrimination if it is equally applied to all new hires. Maybe they were only checking the new hires with poor English?

The Feds are arguing that certain documents aren't needed - you can look at derived documents - like driver's license vs. passport, birth certificate, or green card. It means that you'd need to trust the government officials who verified the illegal vs legal status when they issued the driver's licenses.

Seems to me, it's the corrupt government covering their butts in case improperly issued ID turns up. Same thing the company was trying to do to protect against charges of hiring illegals.

It'd be interesting to know how many got checked for valid driver's licenses who couldn't produce valid immigration documents.

I guess that's the $700,000 question. What are the statistics on that?
