Because selective prosecution claims are fairly common.
Such a defense should also work for the Call of Duty n00b, Jack Teixiera.

And every other classified documents case will then be thrown out because, you know, Trump got a pass, and Brandon got a pass, and Hillary got a pass ...

If you don't believe so, you must believe in the two-tiered justice system that you constantly rail against, but only when Trump is the "victim" ...
