I think you are missing the part where the prosecution didn't prove #1, even if you think it's a crime.

There was no witness who said it wasn't a legal fee, even though it was "billed" by Cohen as such. The prosecutors did not offer a CPA or any expert witness to state for the record that it wasn't a legal fee.

Also, there was no witness who testified that Trump authorized how the payment was classified on the books. Trump didn't do it, obviously, and no witness said he directed how it should be accounted for.

So no... you are 100% wrong on the facts and law on item #1.
