Yes, prosecuting a president requires a high level prosecutor approved by the senate.
He wasn't president when he tried to illegally retain documents.

He claims that those documents were declassified de facto back when he was president, but that really stretches logic.

Doesn't matter, though. The case got dismissed on a technicality.

Funny how said "technicality" matters when it comes to prosecuting (sorry, pErSeCuTiNg) the Orange Survivor, but "technicalities" don't matter when it comes to classified documents because, you know, documents are "overclassified" ...
