I agree with you wholeheartedly, but let us not underestimate the value of political points to prosecutors. These "political points" are the "currency" of public officals and bureuacrats. Rudolph Guliani would have never gained the momentum to win the NYC Mayoral election if he did not score points by bagging Michael Milken. Many said that Milken was unfairly persecuted (being from outside of the old boys club), and I can see thier point.

His family members were investigated and indicted, etc., etc. He was never convicted of his original charges, and what he was eventually forced to plea guilty to sent him to jail for several years, while no other indiviual convicted of those same securities related crimes ever recieved more than a nominal slap on the wrist.

While criminal charges would be much more of an investor friendly deterrent than civil charges, thers must be an adequate method of checks and balances to prevent the abuse of any newfound power on the behalf of overzealous prosecutors and aspiring politicians looking to dethrone the "man of the day," or the guy who has made the wrong enemies.
