Brendan: Very simply, because they are not "loser" law firms and the suits are not frivolous. The courts have a method for sanctioning parties who institute frivolous litigation - it's called Rule 11 - and the penalties can be severe. I would venture to guess that none of these law firms would file any suit which would subject them to Rule 11 sanctions. They no doubt have vigorous due diligence policies and their management committees probably have final oversight. It has been my observation that in the case of a "judgment" call, most reputable firms choose to be conservative and reject a case.
