Amati and Telebit have some DMT implementation patents
Lucent has some CAP implementation patents which is a form of QAM
No-one has any useful QAM patents (its too old)
CAP is QAM and DMT is many little QAM channels.

I don't believe patents will play a big role as the standards bodies (ITU, ANSI, IEEE, ETSI etc..) insist ( if you want a standard) that you the patent holder offer a non-discriminatory reasonable price license to all comers and QAM has a good shot at being a player and its is free and clear besides. Its also possible to implement around patents in some cases.

Thats just my opinion.
