But don't legislators there have the ability to decide this, and if they do so in a way inconsistent with public sentiment, aren't said legislators subject to being voted out in due course?

If the legislators don't come up to your standards then you have the choice of trying to vote them out or moving to someplace else.

I actually think subgrouping by state works pretty well. Having the extremist wack jobs on the West Coast with and the worst of the worst in NYC seems to work pretty well. If you don't like the state you're in just pick one that's a better match and relocate!
