Neldon wins again !!!

Following is text copy/pasted directly from Doc #60 in case 2:21-cr-513 on 12/26/2024:

The United States, pursuant to Fed. R. Crim. P. 48(a), moves for leave to dismiss the Indictment filed against the defendant Neldon Johnson in this case. The Indictment in this case was returned by the grand jury on December 8, 2021. The defendant is years old and has been diagnosed by Dr. Marc Nuttall, an oncologist, “with stage four cancer” and “is terminally ill.” His “prognosis is that his condition will not improve” and is unable “to attend court” or “withstand the riggers of a trial.” For these reasons, the United States submits that dismissal of the Indictment, without prejudice, is appropriate

There can be no "Guilty" verdict returned if Neldon is physically unfit to attend a trial.

So maybe "Neldon wins again !!!" is a bit too strong of an assessment.

Neldon just "kind'a" won, because he can't lose a case that won't be held.

The case was actually a foregone conclusion against Neldon & Glenda (RIP) because a witness saw them discarding pertinent information after being ordered to deliver everything to the court.

Note the term "riggers", should actually be "rigors".

A sarcastic guy might suggest that the court was rigged.

Fortunately, I'm not a sarcastic guy.

Sure is a pretty day.
