Capitalism has the fix for a greedy licensor: an alternative IP emerges to either keep the greedy licensor in check or to bury the licensor. Now, that might take time and money, but that's our system.

A court is not an alternative to a system with those incentives; involvement of the court will simply gum up the works and entrench existing players. The courts are not equipped to play the role of picking winners and losers; courts are equipped to enforce/interpret existing agreements. Courts are too slow, lack expertise, operate on a different clock, are not responsive to markets, etc.

I view the Q CC as seeking damages/remedy for the breach of an existing agreement and a mechanism for time so as to allow ARM alternatives to emerge (or a tool to negotiate a settlement).
