My law firm recently commenced a class action suit against Bally's Total Fitness. The primary thrust of the suit is our claim that Bally's standard form of contract violates the Connecticut laws that regulate health club contracts. The major problems are that the contracts automatically renew and that those financing the contracts have to pay off their membership fees over a time period that exceed the duration of the contract. Other problems relate to the failure to include mandatory language in the contracts, failure to include other mandatory language in as prominent a fashion as required, failure to offer contracts of one year duration, and failure to post certain notices concerning the types of contracts that are available and concerning cancellation rights in a prominent fashion.
