The mere fact that you think "it should go to the courts" is already pure bullshit.

If you don't like the 14th amendment, there is already an amendment process.

But nope, you obviously can't do that, so instead you put your political chips into a stunt that goes way beyond judicial activism.

It smacks Constitutional originalism right in the face.
