Some would call it a loophole but it isn't. It is just tax law.
Well first of all, the word "loophole" is very misunderstood.

Second, who wouldn't structure their income and expenses in ways that minimize tax exposure?

And third, let's say Tesla has windfall profits in the near future, but ends up paying taxes on more earnings than their GAAP earnings indicate, all because Tesla now has to account for depreciation that now has to be GAAP-reported, but cannot be used to offset taxable income.

What then? Will people now say that Tesla is paying "more than their fair share"? I highly doubt it.

There are many things to criticize Musk over, but tax structuring isn't one of them.
