Has the attorney mentioned whether or not the trademarked name "Next Level" has been used in the past two years? It will be incumbent on this new "Next Level" to prove that they haven't.

If the trademark holders have at least kept registration current with the NBA and NCAA, I'd think this new one wouldn't have a leg on which to stand.
