It may be a very innocuous mistake on the part of Next Level. These kinds of trademark collisions happen with amazing frequency, which is why there are so many lawyers who specialize in the issue.

It's extremely likely the company lacks tonto's abilities and doggedness regarding research, and simply didn't know this other name existed.

I would think that any of the following (and others) would be possible scenarios:

1. Company backs off and changes name. I don't know what the effect would be, but expect it'd be major since a lot of work and money have purportedly been spent on this name and logo.

2. Company acquires trademark from current owner.

3. Company is able to prove the current owner abandoned the name and it's now up for grabs.

I think the first scenario is, by far, the most likely, but the other 2 are certainly possibilities.
