Legal Paths to Deport Threats Without Full Due Process

The U.S. Constitution guarantees due process to all persons, there are limited exceptions the government can use to deport individuals who pose a threat to national security:


National Security Grounds:
Non-citizens involved in terrorism, espionage, or efforts to overthrow the government can be deported under existing immigration laws (INA § 237).

Expedited Removal:
Applies to recent arrivals (less than 2 years in the U.S.) and allows deportation without a court hearing, unless asylum is claimed.

Enemy Combatant Designation:
Used in war or terrorism contexts to detain or remove hostile actors without standard process. Rare and subject to court oversight.

Use of Classified Evidence:
Immigration hearings involving national security threats may use classified information in secret, limiting the accused’s defense.
