I stated the applicable law "doesn't distinguish between a fist and a sandwich." The perp was arrested and arraigned on a felony assault charge under 18 U.S.C. § 111(a).
The applicable standard here isn't "fist vs. sandwich," but rather "reasonable fear of death or great bodily harm."

No jury is going to consider a sandwich to be a deadly weapon. No jury is going to consider that perp's fists to be a deadly weapon.

You explicitly stated that the standard for felony assault applies here, whether it be fist or sandwich, but it clearly does not.
