Um, tell me where it states they don't have rights. The Constitution does distinguish between citizens and persons, slaves and all you know, but nowhere does it talk about a third category. Nor does it detail the rights of the named groups, just how their representatives are apportioned.

So what part of the Constitution are you referencing?
