They have so carefully researched and crafted the rule that they aren't aware of the fact that Intel sold its Dalian fab to Hynix quite awhile ago.

If I recall Intel sold to SK their SSD division immediately and sold the fab in a transfer expected to occur some time in 2025.

SK's Soladign SSD entity is (I think) the result of this purchase. But the fab itself was sold with actual transfer a few years down the road, I think it legally changes hands this year.
