I just checked the Supreme Court docket for this case. The parties have agreed to expedite briefing and argument such that all the briefing will be done by the end of October, with oral argument to be held in early November. That’s an incredibly tight schedule. The SC doesn’t have to follow that schedule, but it might. With that schedule, we could get a decision by Jan 26.

If the SC doesn’t its job correctly, it shouldn’t matter whether trade deals have been signed. The question is whether the president has authority to unilaterally declare emergencies and impose tariffs, sometimes as part of political vendettas. If tariff money has to be returned, so be it. Whether a majority of this court see it that way, who knows. The split decision in the Federal Circuit shows this ain’t no slam dunk.
