At that time, however, patent law didn't contain provisions guarding "look and feel" that today would be a cause of action against patent infringement.

In today's world, that kind of imitation not only can get someone into legal trouble, but it can also turn potential buyers away from a device that offers little if anything really new. Is it time for investors to maintain a short position against copycat companies? I don't know the answer, but in a period of economic and political turmoil, it may become insurance against a major market correction.
