Mineral rights in Oklahoma refer to the ownership of subsurface resources such as oil, natural gas, coal, and other minerals beneath a property. Unlike many states, Oklahoma treats mineral rights as a distinct form of real property that can be severed (separated) from surface rights, allowing independent ownership, sale, or leasing. This severance often occurs through a deed reservation or sale, and once severed, the mineral estate is considered dominant over the surface estate, meaning mineral owners have priority for access (e.g., drilling) with obligations to compensate surface owners for damages. Under Oklahoma's Marketable Record Title Act, severed mineral rights that remain unused or unclaimed for 30 years may revert to the surface owner, providing a mechanism for reunification.
