Florida law (specifically
House Bill 293 from 2024) now prevents HOAs from outright banning permanent backup generators and hurricane protection, but HOAs can still set reasonable rules for aesthetics like color, placement (e.g., screened from the road), and ensuring compliance with building codes. Homeowners must still follow HOA approval processes and get local permits, but the HOA must allow installation if it meets code and community standards, not prohibit it entirely.
